Terms of Service

Welcome to Larkin! These Terms of Service ("Terms") govern your use of the Larkin mobile application and related services (collectively, the "Service") operated by Larkin AI, LLC ("Larkin," "we," "our," or "us").

By creating an account or using Larkin, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Larkin is a family calendar assistant designed for parents. The Service provides:

• Email parsing — Intelligent extraction of family-related events from your Gmail inbox (read-only access)
• Calendar management — A unified family schedule combining parsed events with your Google Calendar
• AI-powered features — Gift suggestions, meal planning, family narratives, and morning/evening briefings powered by Google Gemini AI
• Document Vault — Scanning, storing, and organizing family documents via Google Drive
• Notifications — Customizable push notifications for schedule reminders, weather alerts, and family updates
• Shopping list sync — Integration with Instacart for meal planning grocery lists

2. Account Registration

2a. Sign-In Methods

You may create an account using Google Sign-In or Sign in with Apple. By signing in, you authorize Larkin to receive basic profile information (name, email) from your chosen provider.

2b. Account Requirements

• You must be at least 18 years old to create a Larkin account
• You must provide accurate, current information
• You are responsible for maintaining the security of your account
• You may not create multiple accounts for the same household
• You must not share your account credentials with others

2c. Account Security

You are responsible for all activity that occurs under your account. Notify us immediately at support@heylarkin.com if you believe your account has been compromised.

3. Google Account Integration

With your explicit consent, Larkin integrates with the following Google services:

Important:

• You grant access via Google's standard OAuth consent flow
• Larkin only accesses data necessary for its stated features
• You can revoke access at any time through the app or your Google Account permissions
• Revoking access immediately stops all processing of the associated service
• Larkin's use of Google APIs complies with the Google API Services User Data Policy, including the Limited Use requirements

4. Permitted Use

Larkin is provided for personal, non-commercial family management use. You may use Larkin to:

• Manage your family's schedule and events
• Parse emails from schools, sports organizations, and other family-related senders
• Store and organize family documents
• Plan meals and manage grocery shopping
• Receive schedule-related notifications and briefings

5. Prohibited Conduct

You agree not to:

• Use Larkin for any commercial, business, or organizational scheduling purpose
• Attempt to extract, reverse-engineer, or manipulate Larkin's AI system prompts or models
• Use automated tools, bots, or scripts to access the Service
• Submit content designed to exploit, confuse, or manipulate the AI parsing features (prompt injection)
• Interfere with or disrupt the Service or its infrastructure
• Attempt to access other users' accounts or data
• Use the Service to process, store, or transmit malware or malicious content
• Circumvent, disable, or tamper with security features (including Firebase App Check)
• Violate any applicable local, state, national, or international law
• Use the Service in any manner that could damage, disable, or impair the Service

6. Intellectual Property

6a. Larkin's Property

The Larkin app, including its design, code, AI models, algorithms, branding, and documentation, is owned by Larkin AI, LLC and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.

6b. Your Data

You own your data. Content you provide to Larkin (family information, documents, preferences) remains yours. We claim no ownership over your personal data. See our Privacy Policy for details on how we handle your data.

6c. AI-Generated Content

Content generated by Larkin's AI features (event summaries, gift suggestions, meal plans, narratives) is provided for your personal use. We do not claim ownership of AI-generated content created from your data.

7. User Data & Privacy

Your privacy is important to us. Our Privacy Policy describes in detail what data we collect, how we use it, and your rights. Key points:

• We collect only what is necessary for Larkin's features
• We do not sell your data to third parties
• We do not use your data for advertising
• You can export all your data at any time
• You can delete your account and all associated data at any time
• Email bodies are processed in memory and never stored
• OAuth tokens are encrypted at rest

8. AI-Generated Content Disclaimer

Larkin uses artificial intelligence (Google Gemini AI) to parse emails, suggest events, generate meal plans, provide gift ideas, and create family narratives.

Please understand:

• AI parsing may occasionally misinterpret email content, dates, times, or locations
• AI-generated suggestions are recommendations only and may not be appropriate for your situation
• You are responsible for reviewing and verifying all calendar events before relying on them
• Larkin is not a substitute for professional advice of any kind (medical, legal, financial, nutritional, or otherwise)
• AI features depend on third-party services (Google Gemini) that may experience downtime or changes
• We continuously improve our parsing accuracy but cannot guarantee error-free results

Always verify important dates, times, and details directly with the original source (school, doctor's office, sports league, etc.).

9. Third-Party Services

Larkin integrates with third-party services to provide its features. These services are governed by their own terms and privacy policies:

Larkin is not responsible for the availability, accuracy, or practices of third-party services. If a third-party service experiences downtime, certain Larkin features may be temporarily unavailable.

10. Document Vault

The Document Vault feature allows you to scan and store family documents (report cards, medical records, school forms, etc.).

Important:

• Documents are stored in your own Google Drive in a dedicated Larkin folder
• Larkin processes documents to extract metadata (document type, dates, family member) for organization
• You are responsible for the content of documents you scan and store
• Do not use the Document Vault to store highly sensitive documents (e.g., Social Security cards, financial account details) unless you understand and accept the risks of cloud storage
• If you revoke Google Drive access or delete your Larkin account, document metadata in Larkin is deleted, but files in your Google Drive remain under your control

11. Subscription Terms

11a. Free Tier

Larkin currently offers a free tier with core features. The specific features and limitations of the free tier may change over time.

11b. Future Paid Tiers

We may introduce paid subscription tiers in the future. If we do:

• Pricing and features will be clearly communicated before any charge
• Subscriptions will be processed through the Apple App Store or Google Play Store
• Billing terms will follow the respective platform's policies
• You may cancel your subscription at any time through your device's subscription management
• Refunds are subject to the policies of Apple or Google, as applicable

11c. Changes to Pricing

We reserve the right to modify pricing for paid tiers. Existing subscribers will be given at least 30 days' notice before any price increase takes effect.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy — We do not guarantee that AI-parsed events, suggestions, or content will be error-free
• Availability — We do not guarantee uninterrupted access to the Service
• Fitness for Purpose — We do not guarantee the Service will meet all of your scheduling needs
• Third-Party Services — We do not guarantee the availability or performance of integrated third-party services

LARKIN IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, LEGAL, FINANCIAL, OR OTHER ADVICE. Any health, legal, or financial information parsed from your emails is provided for scheduling convenience only and should not be relied upon as professional guidance.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Larkin AI, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or $50, whichever is greater
• We are not liable for any damages resulting from: incorrect AI parsing, missed or incorrect calendar entries, third-party service outages, unauthorized access due to your failure to maintain account security, or data loss beyond our reasonable control

14. Indemnification

You agree to indemnify, defend, and hold harmless Larkin AI, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third party's rights
• Content you provide to the Service

15. Modifications to Terms

We may update these Terms from time to time. When we make changes:

• We will update the "Last Updated" date at the top of this document
• For material changes, we will notify you through the app or by email at least 14 days before the changes take effect
• Your continued use of Larkin after the effective date of updated Terms constitutes your acceptance

If you do not agree to the updated Terms, you must stop using the Service and delete your account.

16. Termination

16a. By You

You may stop using Larkin at any time. You may delete your account at any time through the app's settings, which will permanently remove all your data from our systems.

16b. By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in prohibited conduct (Section 5)
• We are required to do so by law
• The Service is discontinued

If we terminate your account for a reason other than a Terms violation, we will provide reasonable notice and an opportunity to export your data.

16c. Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We will delete your account data in accordance with our Privacy Policy
• Documents in your Google Drive remain yours
• Events already created on your Google Calendar remain yours
• Provisions that by their nature should survive (Sections 6, 12-14, 18) will survive termination

17. Dispute Resolution

17a. Informal Resolution

Before filing any formal legal action, you agree to contact us at support@heylarkin.com and attempt to resolve the dispute informally for at least 30 days.

17b. Arbitration

If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in English.

17c. Exceptions

Either party may bring claims in small claims court if eligible. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property infringement or unauthorized access to the Service.

17d. Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Massachusetts.

20. General Provisions

20a. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

20b. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Larkin AI, LLC regarding the Service, superseding any prior agreements.

20c. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

20d. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

20e. Force Majeure

Larkin shall not be liable for any failure or delay in performing its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, or third-party service outages.
